Terms and Conditions

1 Introduction

The Site(edoowa.com) is an one-stop-shop for oversea students. It provides introductory services between oversea students and schools and between oversea students and editors. The Site also provides services for training oversea students to successfully obtain necessary skills and knowledge in the environment of the international schools. To use the Site, all users must agree any term set out below or just do not use the Site and its services.


2 Definition

2.1 Student means that anyone intends to study oversea or anyone with a student visa is studying oversea.

2.2 School means that any registered educational provider under its country regulation, legislation, and law can intake oversea students, including universities, colleges, and high or language schools.

2.3 Editor means an entity or individual who has the necessary qualification to assist the oversea student for editing of its writing assignments.

2.4 Service Provider is a collective term for School, Editor, and third party partners.

2.5 User means anyone or any entity who uses the Site and services, including the student and the service provider.


3 Contract

3.1 This Terms and Conditions, together with the terms set out under the Intellectual Property Policy, the Privacy Policy, the Payment and Refund Policy, form an entire legal binding agreement between the Site and the User. By accessing and using the Site, the User agrees to comply with and is legally bound by this entire agreement.

3.2 The User has read, understood and accepted these terms under the Terms and Conditions, the Intellectual Property Policy, the Privacy Policy, and the Payment and Refund Policy. The User acknowledges that it has sufficient opportunity to access them.

3.3 The User guarantees that it has a legal age under its countries’ law and capacity to enter into a contract for service or is under a legal age by its countries’ law with the approval of its parents or guardian.


4 Registration

4.1 The User must create one account only on the Site. The Service Provider and the student create an account for the Service Provider and the student under the relevant register section of the Site.

4.2 Basic information is required to create an account during the registration process on the Site. The User is required to provide name, location, email address, username and password(Hashed).

4.3 The School guarantees that it is registered with proper authorities to provide educational service in its country and can make an offer for the oversea student.

4.4 For security and confidentiality, the User is requested by the Site to change its password regularly and not to disclose it to any third party. The User agrees that it is its own responsibility for any activities or actions under its account, whether or not it has authorised such activities or actions.

4.5 The User will immediately notify the Site for any unauthorised use of its account.

5 Profile and Content

5.1 The School and Editor agree that it is its own responsibility to create its profile without the email address, name of street, and contact phone number or any identifiable information.

5.2 The School guarantees to provide a detailed course list for course searching by the oversea Student on the Site.

5.3 Each Service Provider represents and warrants that any content that it provides or posts and any profile that it posts is complied with the Intellectual Property Policy of this Site.

5.4 The User agrees to provide accurate, current and complete information for the registration and any content on the Site and to update such information to keep it accurate, current and complete.


6 Terms for Digital Goods

6.1 See the Payment and Refund Policy for digital goods.

6.2 The User agrees to allow the Site to send the statement via email and/or the User can access Account section of the Site to view this statement.


7 Terms for Introductory Service Only

7.1 The Site provides the introductory service to facilitate between the Service Provider and the Student with limited liabilities.

7.2 The School agrees to provide information about course details listed on the Site to the Student, to accept and process the application applied for the course via the Site.

7.3 The Editor agrees that it will provide a quote to any Student in a reasonable time frame and complete the editing assignment prior due date.

7.4 The Student agrees to provide all information and documents necessary for the application of universities, colleges, or schools, or provide a completed assignment to the Editor for editing.

7.5 Any agreement or arrangement between the Service Provider and the Student is solely among the Service Provider and the Student. The Site is strictly and expressly not part of such agreement or arrangement.

7.6 The User may contact the Site for general information, however, the User acknowledges that the general information provided by the Site is not for planning, accounting, taxation, financial or legal advice. For such information, the User should contact professional services.

8 Advertisement Placement

8.1 The School may seek to place advertisements on the Site by contacting the Site. The School acknowledges and agrees that the advertisement is rotated across the Site.

8.2 The School agrees that it provides one skyscape banner(160x600px) and one rectangle banner(600x160px). Special request may be considered on the individual case basis.


9 Prohibited Activity

9.1 By use of the Site and Service, the User must not and agrees that it will not:

9.1.1 Create more than one account and/or profile or on behalf of another individual and/or entity;

9.1.2 Upload any content that is fraudulent, misleading, false, deceptive, or defamatory, offensive, obscene, pornographic, vulgar, promoting discrimination, racism, hatred, or harm against any individual, group or the Site;

9.1.3 For the School, make any course offer to the Student on its course list that it does not intend to honour or cannot provide;

9.1.4 For the Editor, make any quote to the Student for the editing assignment that it does not intend to honour or cannot provide;

9.1.5 For the Student, make any purchase offer to the School, Editor or the Site that it does not intend to honour, or submit a school assignment to the Editor for editing by plagiarism;

9.1.6 Use the Site and Service to find a student and then complete, or assist another individual to complete a transaction independent of the Site in order to avoid any commission related to the service provided by the Site;

9.1.7 Use the Site and Service for any other purposes that are not permitted by these Terms, or any unsolicited commercial email, spam or advertisement;

9.1.8 Violate any applicable rule, regulation or law of any local, state and nation, or advocate, encourage or assist any third party in doing any of the foregoing.


10 Disclaimers

10.1 The Site does not guarantee that the School or the Editor will be selected by the Student and the Student will find any course listed on the Site or any Editor for its assignment.

10.2 The Site may display any profile and course list on the front page based on the advertisement module the School chooses. The Site does not endorse any profile and course list on the Site.

10.3 Although the Site displays total job completed on any profile of the Editor who has successfully completed the student assignments, it does not guarantee the future successful rate of the Editor on the Site.

10.4 The Site cannot and does not guarantee the content included in the account, profile, or course list that is reliable, accurate or complete. The User is responsible for the determination of selection of the Service Provider or the Student.

10.5 The Site does not warrant that the Site, Service, functionality and the User’s access the Site and Service will be available all the time, or without any interruption and change, or error free. It is User’s own risk to use the Site and service.

10.6 The Site can not guarantee that the server and/or database for the Site is free of viruses, or any other harmful components within the network although it will be corrected as soon as noticed.

10.7 The Site is not responsible for any loss, damage, or expense whether direct, indirect, or consequential relating to use the Site and service, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, system failure, or any damages for any personal and emotional distress, bodily injury, or death by the User.

10.8 The Site may include links to other sites. It does not have any association with or endorse the linked sites. The User shall check the terms and conditions from each linked site before using the linked site. The Site is not responsible for any content on or practices of the linked sites.

10.9 For the avoidance of doubt, the Site is not responsible for any taxation, visa, immigration, travel arrangement, health insurance cover, tuition fee, living expense, accommodation associated under these Terms, or for a service provider’s compliance with applicable rules, regulations, and laws.


11 Limitation of Liability

11.1 The User agrees that it will not, or does not seek any liability or legal remedy from the Site in relation to use or access the Site and service.

11.2 To the fullest extent permitted by laws, the total liability arising out of or in connection with the Site and Service, including but not limited to negligence will not exceed the total fees paid by the User to the Site.


12 Indemnity

12.1 The User agrees to indemnify fully to the Site, its parent company, affiliates, directors, contractors and employees from any liability, claim, fee, and/or expense, including but limited to reasonable attorney’s fees, arising out of user’s use or access the Site and Service and/or user’s violation of any term of this Terms and Conditions and/or any term of the Intellectual Property Policy, the Privacy Policy and the Payment and Refund Policy.


13 Amendment and Dispute

14.1 The Site’s employees and any third party do not have authority to change this Terms and Conditions or any term of the Intellectual Property, the Privacy Policy, the Payment and Refund Policy.

14.2 The Site may amend any term of this Terms and Conditions and/or the Intellectual Property, the Privacy Policy, and the Payment and Refund Policy from time to time without prior notice. Use of the Site and service under such amendment is deemed to be considered as the User’s acceptance of this amendment. The User is advised to check this Terms and Conditions and/or the terms of the Intellectual Property Policy, the Privacy Policy, and the Payment and Refund Policy regularly.

14.3 Any amendment in relation to this Terms and Conditions and/or the terms of the Intellectual Property, the Privacy Policy, and the Payment and Refund Policy will be displayed on this page of the Site and/or distributed through the email when an update occurs.

14.4 If the Site does not exercise or enforce any term contained in this Terms and Condition and/or the Intellectual Property Policy, the Privacy Policy, and the Payment and Refund Policy, it is not treated as a waiver of any such term from the Site. Any waiver must be explicitly stated that it is a formal waiver and the Site communicates it to the User in writing.

14.5 If any term of this Terms and Conditions and/or the Intellectual Property Policy, the Privacy Policy and the Payment and Refund Policy is deemed unenforceable, invalid or illegal to any extent by any competent authority, this Terms and Conditions and/or the Intellectual Property Policy, the Privacy Policy and the Payment and Refund Policy as a whole shall not be deemed unenforceable, invalid or illegal, but only that term of this Terms and Conditions, the Intellectual Property Policy, the Privacy Policy, and the Payment and Refund Policy that is unenforceable, invalid or illegal shall be severed.

14.6 Any dispute about any term of this Terms and Conditions, the Intellectual Property, the Privacy Policy, and the Payment and Refund Policy, or involving the Site and Service will be governed by the laws of Australia and shall be subject to the exclusive jurisdiction of the Supreme Courts in NSW, Australia only.


15 Cancellation

15.1 The User can cancel its account any time by contacting the Site on admin@edoowa.com and shall reimburse the Site any unpaid payment.

15.2 The Site reserves the right, at any time and without prior notice, to lock or disable access to any account, profile and/or content displayed, or to cancel the User’s account, for any reason in violation of any term of this Terms and Conditions and/or the Privacy Policy, the Intellectual Property Policy and the Payment and Refund Policy or otherwise harmful to the Site and service.
